Saginaw Court System Overview

Saginaw County is served by two main state courts: the 10th Circuit Court (circuit court) and the 70th District Court (district court). Both courts are located in the Saginaw County Governmental Center. The circuit court is a court of general jurisdiction that handles serious criminal cases, large civil claims, and family matters. Five circuit court judges serve in the 10th Circuit Court, including the presiding family court judge. The district court handles misdemeanors, small civil claims, traffic violations, and conducts preliminary hearings in felony cases.

District Court Cases in Saginaw

In Michigan, the term "district court" refers to a court of limited jurisdiction — the 70th District Court fulfills this role in Saginaw County. This court handles misdemeanors, civil cases with claims up to $25,000, traffic violations, DUI cases, and conducts preliminary hearings in felony cases.

When a district court judge finds sufficient grounds during a preliminary hearing, a felony case is transferred to the 10th Circuit Court. The circuit court clerk processes these transferred cases. Civil cases with claims over $25,000 also go directly to the circuit court.

Magistrate Court Cases in Saginaw

Michigan does not have a separate magistrate court as an independent entity. Magistrates work within the district court. In Saginaw County, magistrates in the criminal division of the 70th District Court conduct initial court appearances (arraignments), set bail amounts, and handle minor offenses.

Small claims in Michigan are limited to $6,500. Civil cases in the district court are heard for amounts up to $25,000. Magistrates also handle traffic violations and some civil infractions. If the case load is large, individual magistrates may specialize in certain categories.

Family Law, Probate, and Juvenile Matters in Saginaw

Family Law. Divorce, child custody, child support, protective orders (PPO), paternity establishment, and termination of parental rights are all handled by the 10th Circuit Court. The presiding family court judge coordinates these cases. You can contact the circuit court records department at (989) 790-5540.

Probate. The Saginaw County Probate Court handles estate administration of deceased persons, appointment of guardians and conservators, and trust matters. This court operates separately from the circuit and district courts.

Juvenile Matters. Cases under the Juvenile Code and Child Protective Act are also handled within the family division of the circuit court. Juvenile case records are confidential under Michigan law and not subject to public access.

How Cases Move Through the Saginaw Court System

  1. Case Initiation: a criminal complaint, civil lawsuit, or petition is filed with the appropriate court. The clerk registers the case and assigns it a number.
  2. Judge Assignment: the case is distributed among judges according to the court's internal rules.
  3. Initial Hearings: in criminal cases — arraignment (charges announced and bail set); in civil cases — scheduling conference.
  4. Pre-trial Phase: motions filed, evidence exchanged (discovery), plea negotiations in criminal cases, or settlement negotiations in civil cases.
  5. Case Resolution: trial, plea, settlement, or default judgment.
  6. Post-Resolution: sentencing in criminal cases, filing appeals, enforcement of court judgment.

The status of any case can be checked through the MiCOURT Case Search. Note: some courts display information on criminal convictions only for the last seven years.
